Terms of Service — Mellow

These terms are an agreement between you and MELLOW LLC ("Mellow", "we", "us") covering your use of the Mellow mobile app. Purchases on the mellowsleep.com store are covered separately by the store's own terms and policies. By using the app you accept these terms; if you do not accept them, do not use the app.

1. The service

Mellow is a free sleep companion app: a 7-day sleep curriculum, wind-down meditations, sleep stories, an ambient sound mixer, bedtime reminders, daily sleep check-ins, and a care guide. The app contains no advertising and no in-app purchases. Some features stream content over the internet; downloaded content plays offline.

2. Eligibility

You must be at least 18 years old to use Mellow. The app is not directed at children.

3. Accounts

You can sign in with Google or Apple, or use the app as a guest. You are responsible for the security of the Google or Apple account you sign in with. You can delete your account at any time in the app (Profile → Delete account) or via mellowsleep.com/pages/delete-your-mellow-account-and-data; see our Privacy Policy for exactly what deletion removes and the one anti-abuse record that is retained.

4. Not medical advice

Mellow provides general educational and wellness content about sleep. It is not medical advice, is not a medical device, and does not diagnose, treat, cure, or prevent any disease or condition. If you have or suspect a sleep disorder or any other health condition, or before changing anything about your health routine, consult a qualified healthcare professional. Never disregard professional medical advice because of something in the app. If you are in crisis, contact your local emergency services.

5. Store credit promotion

The app may offer a one-time promotional store credit (currently USD $20; the exact amount is set on our servers and may change or end at any time without notice). The following terms apply:

• One credit per email address, ever. This limit is enforced with a hashed record of your email that survives account deletion — deleting your account and re-registering does not grant a second credit.

• Claiming requires a Google or Apple sign-in; guest accounts must sign in first.

• The credit is issued as Shopify store credit on your mellowsleep.com customer account and is redeemable only on mellowsleep.com.

• It has no cash value, cannot be transferred, resold, or exchanged for cash or gift cards, and applies to product purchases per the store's checkout rules.

• We may withhold or revoke credits obtained through fraud, abuse, or automated account creation, and we may modify or discontinue the promotion at any time. Credits already issued to your store account remain governed by the store's policies.

6. Acceptable use

You agree not to: use the app for any unlawful purpose; attempt to gain unauthorized access to our systems or other users' data; probe, scrape, or disrupt our infrastructure; create accounts by automated means or claim promotional credits through multiple identities; or copy, extract, redistribute, or publicly perform the app's audio and written content outside the app.

7. Intellectual property

The app, and all content in it — audio sessions, meditations, sleep stories, ambient sounds, text, and design — are owned by MELLOW LLC or its licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app and its content for your own private, non-commercial use. All other rights are reserved.

8. Termination

You can stop using the app or delete your account at any time. We may suspend or terminate your access if you breach these terms, abuse the promotion, or harm the service, and we may discontinue the app or any feature. Sections 4, 5 (limits on issued credits), 7, 9, and 10 survive termination.

9. Disclaimers and limitation of liability

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. To the maximum extent permitted by law, MELLOW LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising from your use of the app; our total aggregate liability for all claims relating to the app is limited to USD $50. Nothing in these terms excludes liability that cannot be excluded under applicable law, and nothing limits the statutory rights of consumers in jurisdictions that guarantee them.

10. Governing law

These terms are governed by and construed in accordance with the laws of the United States, except where the consumer-protection law of your country of residence requires otherwise.

11. Changes

We may update these terms; the effective date above will change and material changes will be announced in the app. Continuing to use the app after a change means you accept the updated terms.
